Should I buy services, products, software, or systems that might help me run my Herbalife Nutrition business?

“Business Tools” are third party services or products that may help you promote, grow, and/or manage your direct sales business. They can be geared toward getting Customers, recruiting other Distributors, communicating with Customers or Distributors, or financial management, among other things. Whatever the purpose, Business Tools like this website are not required to start, progress or succeed as a Distributor or to receive training and support from your Sponsor and upline. No one should tell you that Business Tools are required or pressure you to buy them. Herbalife Nutrition offers comprehensive business management tools for free or at a nominal cost. Their tools are designed to meet your needs and help you run a successful and compliant Herbalife Nutrition business. We strongly advise that you only buy Business Tools if you decide, after a reasonable amount of time as a Distributor, that their cost is justified by their expected benefit to your business, in light of your actual earnings from Herbalife Nutrition. Please also keep in mind that if you buy Business Tools, you will be responsible for how you use them and for their compliance with Herbalife Nutrition’s Rules of Conduct and the law.

Goal Smashing, LLC reserves the right, at its sole discretion, to change, modify, add or remove any portion of these Terms of Use, in whole or in part, at any time by posting revised Terms of Use on the Websites, and we will note near the top of this page the date that any changes are made. Changes in these Terms of Use will be effective when such change is posted. Your continued use of the Websites after any changes to these Terms of Use are posted will be considered acceptance of those changes. Goal Smashing, LLC may terminate, change, suspend or discontinue any aspect of the Websites, including the availability of any features of the Websites, at any time. Goal Smashing, LLC may also impose limits on certain features and services or restrict your access to parts or all of the Websites without notice or liability. Goal Smashing, LLC may terminate the authorization, rights and license given herein.

You must obtain access to the Internet and pay any service fees associated with such access to use the Site. In addition, you must provide all equipment necessary for you to access the Internet. You are and will remain solely responsible for the purchase, hookup, installation, loading, operation and maintenance of any hardware, software, telephone (cable or other) service, and the Internet access service to your personal computer and for all related costs. You are solely responsible for scanning your hardware and software for computer viruses and other related problems before you use them. We expressly disclaim, any liability or responsibility for any errors or failures relating to the malfunction or failure of your hardware or software in connection with the use of the Site or Offerings.

Your use of the Websites is at your own risk, including the risk that you might be exposed to Public Postings (as defined below) that are offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. If you are using the Websites on behalf of your employer, it means you are authorized to accept the Terms of Use and the Privacy Policy on your employer's behalf.

● otherwise violates these Terms of Use or any other guidelines or policies of Goal Smashing, LLC or posted on the Websites.

Goal Smashing, LLC will cooperate fully with any law enforcement officials and/or agencies if requested or required in the investigation of any users who violate these Terms of Use and may disclose your information to such law enforcement officials and/or agencies if required by law.

We are under no obligation to enforce the Terms of Use on your behalf against another user. While we encourage you to let us know if you believe another user has violated the Terms of Use, we reserve the right to investigate and take appropriate action at our sole discretion.

Public Postings
The Websites may contain a discussion board (“Public Forum”) with interactive features that may allow you and other users to post materials such as stories, comments, photos, opinions, your name, email address, and company name, and other information (“Public Postings”).

Goal Smashing, LLC's Right to Use Public Postings and Suggestions

Translation
We may translate these Terms of Use into other languages for your convenience. However, the English version governs your relationship with Goal Smashing, LLC ,and the English version will govern if there are any inconsistencies among the different versions.

Applicable Law
Any dispute arising out of your use of this Website or material from this Website shall be resolved according to the laws of the State of Mississippi, United States of America, without giving effect to that state's principles of conflicts of laws. The federal and state courts of the State of Mississippi shall have exclusive jurisdiction over all claims. By accessing the Websites, you expressly consent to the personal jurisdiction of the federal and state courts of the State of Mississippi.

Termination
